This paper examines how the United States Constitution grants equality to all citizens and how the government is both responsible for creating and upholding this right. In particular, it looks at how different theories have been offered by John Rawls, Robert Nozick, and Kai Nielsen who all differ in their beliefs on what equality is and what course of distributive justice will be most beneficial and fair. It shows how, among the three theories, they share a similar focus on the importance of equality, yet the means for obtaining the goals set forth vary significantly.

"The Harvard professor known as John Rawls, is most known for his ?Theory of Justice,? which is founded upon the concept of ?justice as fairness.? ?These principles are to regulate all further agreements; they specify the kinds of social cooperation that can be entered into and the forms of government that can be established. This way of regarding the principles of justice I shall call justice of fairness.? (386) Rawls makes it clear that he is not trying to impose on society or create a certain form of government. Instead, Rawls goes about obtaining justice of fairness through his idea of a social contract in which society is organized to uphold the principles of justice and make them acceptable among society."
